PRAYER :- To relax the condition imposed by this Court in Crl.M.P(MD)No.12368 of 2025 in Crl.A(MD)No.711 of 2024 dated 15.09.2025 on the file of this Court.

ORDER : The Court Made the following order :- The above petition has been filed seeking an order to relax the condition imposed on the petitioner by this Court in Crl.M.P(MD)No. 12368 of 2025 in Crl.A(MD)No.711 of 2024 dated 15.09.2025.

Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 3.While granting suspension of sentence in Crl.M.P(MD)No.2177 of 2025 vide order dated 21.02.2025, this Court imposed the condition directing the petitioner to stay in Madurai and report before the Sellur Police Station, daily at 10.30 a.m. Thereafter, the condition was modified by this Court in Crl.M.P(MD)No.7963 of 2025 vide order dated 24.06.2025, directing the petitioner to appear before the Sellur Police Station, Madurai once in a week i.e on every Monday. The condition was further modified in Crl.M.P(MD)No.12368 of 2025 vide order dated 15.09.2025 directing the petitioner to appear before the respondent police in alternative weeks i.e on the first and third Monday of every month at 2/5

10.30 a.m until further orders. The present petition is filed seeking to relax the said condition.

The petitioner states that he is a daily wager and the sole bread winner of the family and the petitioner states that the condition imposed by this Court to appear before the respondent police in alternative weeks i.e on the first and third Monday of every month at 10.30 a.m until further orders, caused hardship to the petitioner. The petitioner therefore seeks for relaxation of the said condition imposed by this Court.

5. The learned Additional Public Prosecutor submits that pursuant to the order passed by this Court on 15.09.2025 the petitioner did not appear on 23.09.2025 and 29.09.2025 and in all other days, the petitioner has been regularly complying with the condition imposed on him.

6. In the facts and circumstances of the case, this Court is inclined to modify the condition imposed in Crl.M.P(MD)No.12368 of 2025 vide order dated 15.09.2025 to the effect that the petitioner shall appear before the Special Court for POCSO Act Cases, Tuticorin on every first working 3/5

day of English calender month at 10.30 a.m till the disposal of the appeal.

7. Accordingly, this petition is ordered.
