O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to complete the enquiry proceedings in Patta Appeal No.O.Mu.E.3261809/2025/A5 dated 16.05.2025, filed by the petitioner, in a time-bound manner.

2. With the consent of the learned counsel for the petitioner and the learned Special Government Pleader for the first and second respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with the notice to the third respondent, as no adverse orders are proposed to be passed against him.

3. The case of the petitioner is that the property in Survey No.132/5, measuring an extent of 45.5 Acres, originally belonged to the petitioner's grandfather, in whose name patta was also issued. Thereafter, the said property was partitioned among the petitioner's father and his brothers. After the death of the petitioner's father, his share devolved upon the petitioner. During the UDR, the name of the owner was wrongly entered as Vethar Natchi Kaliyarar and thereafter as Chithravelu and is now Page No. 2 of 5

reflected in the name of the third respondent in the patta. Therefore, the petitioner filed an appeal on 25.04.2025 seeking cancellation of the patta issued in the name of the third respondent and restoration of the same to its original position. Taking advantage of the said mistake, the third respondent is attempting to alienate the property. The first respondent has taken the petitioner's appeal on file as Patta Appeal No.O.Mu.E. 3261809/2025/A5 dated 16.05.2025 and directed the second respondent to file a report. However, thereafter, there has been no further progress. Therefore, the petitioner was constrained to file the present Writ Petition.

4. The learned Special Government Pleader appearing for the first and second respondents would submit that the petitioner's appeal would be disposed of within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to dispose of the petitioner's appeal in Patta Appeal No.O.Mu.E.3261809/2025/A5 on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, third respondent and any other interested parties who may be affected by the decision.
