This petition is filed for issuance of Writ of Mandamus, directing the 3rd respondent to grant permission to undergo one day hunger strike in front of the Kollencode Municipality on 22.12.2025 from 10.00 AM to 5.00 PM by considering his representation dated 03.12.2025.

ORDER

This petition is filed for issuance of a Writ of Mandamus, to direct the 3rd respondent to grant permission to undergo one day hunger strike in front of the Kollencode Municipality on 22.12.2025 from 10.00 AM to 5.00 PM by considering his representation dated 03.12.2025.

2. The learned Government Advocate (Crl. Side) appearing for the respondents submitted that since the date sought for conducting the hunger strike falls during the Christmas season and there would be a huge gathering of people, permission could not be granted to the petitioner.

3. The learned counsel for the petitioner would submit that the petitioner had already submitted a representation seeking removal of garbage from a public place; however, the same has not been considered so far. Therefore, the petitioner seeks to conduct a hunger strike to bring the issue to the notice of the Municipality.

4. This Court is of the considered opinion that the cause for which the petitioner seeks permission is to protect the environment and, therefore, the same deserves consideration. However, in view of the apprehension expressed by the respondents due to Christmas celebrations, the date may be modified. Accordingly, the respondents are directed to consider the petitioner's representation and grant permission to conduct the hunger strike on 20.12.2025 from 10.00 a.m. to 5.00 p.m. The petitioner shall not raise any provocative slogans and shall restrict the number of

participants to 50 persons during the hunger strike.

5. With the above direction, this Writ Petition is disposed of. No costs. 18.12.2025 Indu Note: Issue order copy on 19.12.2025.
