O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondents to consider the petitioners representations dated 10.09.2024 and 15.04.2025 and consequently direct the respondents to survey the land of half share at about 0.41 cents in Survey No.481/9, 0.26 cents in Survey No.481/10 and 0.26 cents in Survey No.481/11 totalling half share 46 1/2 cents out of total extent 93 cents situate at No.96, Panangudi Village, K. Chettipatti Panchayat, Thirumaiyam Taluk, Pudukkottai District, by putting the boundary stone. 2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.The learned counsel appearing for the petitioner submits that a representation dated 15.04.2025 was made seeking survey and demarcation of the boundaries of the property in question. Since no action has been taken by the respondents 1 and 2, the present writ petition has been filed.

4. The learned Additional Government Pleader appearing for the respondents 1 and 2 submits that after considering the claims of all parties, proper steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the first respondent to consider and dispose of the petitioner's representation dated 15.04.2025 for survey and demarcation on merits and in accordance with law. Notice shall be issued to the petitioner and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
