ORDER

The present writ petition has been filed seeking to quash the show cause notice issued by the 1st respondent herein calling upon the writ petitioner to offer his explanation for availing passport services by using bogus documents.

2. The petitioner was initially issued with a passport on 29.12.2006 it was valid up to 28.12.2016. The said passport reflected the date of birth of the petitioner as 24.05.1987.

3. After the expiry of the passport, the petitioner has approached the first respondent seeking to re-issue the passport with a change in date of birth as 24.05.1989, for which, the present show cause notice came to be issued by the 1st respondent.

4. This Court had suo motu impleaded the 2nd respondent and directed the 2nd respondent to conduct a discrete enquiry and file a report. Paragraph No.5 of the said report is extracted as follows: "5.It is further submitted that during the enquiry it is learnt that the applicant/petitioner has even travelled abroad using the passport obtained by produced forged records. Since, this is a clear case of forgery, criminal case has been registered in Thiruvegampet P.S.Cr.No. 20/26 u/w. 10(3)(b) & 12(1)(b) Indian Passport Act, 1967, and the people who were involved in creating this forged document, the criminal intent behind this ac shall be deeply probed and appropriate action as per law shall be taken against all those who are behind this criminal act."

5. The 2nd respondent is directed to forward a copy of this report to the 1st respondent.

6.The first respondent is directed to conduct an enquiry in the light of the report submitted by the 2nd respondent and pass orders within a period of four weeks from the date of receipt of a copy from the 2nd respondent.

7. With the above direction, the writ petition is disposed of. No costs. Consequently connected Miscellaneous Petition is closed. 26.02.2026 NCC : Yes/No Index : Yes/No RR TO
