ORDER : The Court Made the following order :- The above petition has been filed seeking an order to relax the condition imposed on the petitioner by this Court in Crl.M.P(MD)No. 10592 of 2025 in Crl.A(MD)No.851 of 2025 dated 20.08.2025.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondent. 3.While granting suspension of sentence, this Court imposed the condition directing the petitioner to appear before the Sessions Judge, Mahila Fast Track Court, Dindigul, daily at 10.30 a.m till the disposal of the appeal. The present petition is filed seeking to relax the said condition.
4. The petitioner states that he is a daily wager and his entire family members depend on his income alone. Because of the condition imposed on the petitioner, he is not able to go to work. The petitioner therefore seeks for relaxation of the condition imposed by this Court. 2/5
5. The learned Additional Public Prosecutor submits that the petitioner has been regularly complying with the condition imposed on him.
6. In the facts and circumstances of the case, this Court is inclined to modify the condition No. 10(ii) imposed by this Court in Crl.M.P(MD)No. 10592 of 2025 in Crl.A(MD)No.851 of 2025 dated 20.08.2025 to the effect that the petitioner shall appear before the Sessions Judge, Mahila Fast Track Court, Dindigul, in the first working day of every English calender month till the disposal of the appeal.
7. Accordingly, this petition is ordered.
