PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the respondent to pay the petitioner the amount payable towards the encashment of 57 days earned leave, surrendered by him in the years before his retirement, either based on his monthly wages of the respective months of surrender of those leaves, together with 18% interest p.a. From the respective due dates or based on the monthly wages payable on the month of his retirement, together with 18% interest from the date of his retirement, within a time frame as may be fixed by this court.

O R D E R

The petitioner served in the respondent transport corporation as a Driver and he retired from service on 30.09.2023. The petitioner with a grievance that though he had surrendered his earned leave of 57 days while he was in service, the respondent has not paid the salary for the same, has submitted a representation to the respondent on 10.11.2025 and has filed this writ petition for a direction to the respondent to pay the salary for the surrendered earned leave.

2. Mr.K.Ramiah, learned counsel takes notice on behalf of the respondent and submits that they would consider the case of the petitioner and pay the eligible leave salary if any. 3.Since the petitioner claims that he has not been paid with salary for the surrendered earned leave, the respondent shall 2/4

consider the case of the petitioner and pay the eligible amount, if already not paid, within a period of twelve weeks from the date of receipt of a copy of this order together with interest at 6% per annum.

4.This writ petition is allowed with the above direction. No costs.
