ORDER

This Criminal Original Petition is filed to call for the records relating to the Calendar Case pending in CC No.334/2024 on the file of the Judicial Magistrate No.1, Madurai and quash the same as illegal and arbitrary as against the petitioner / accused No.2.

Learned counsel for the petitioner submitted that the petitioner is the second accused in the case registered in Crime No.10 of 2018 registered for the offences under Sections 406, 420, 120B and 34 of IPC. The petitioner's husband who passed away in the year 2020 was the first accused. The case of the prosecution is that the first accused had approached the defecto complainant and five others introducing himself, as if he had been working in the Secretariat who could arrange jobs for them. Believing the words of the first accused, the defecto complainant and others had totally given an amount of Rs.27,50,000/-. Hence the present case in Crime No.10 of 2018 came to be registered and the same has culminated in filing charge sheet in C.C.No.334 of 204 on the file of the learned Judicial Magistrate No.1, Madurai. Seeking quashment of the same the present Criminal Original Petition came to be filed. 2/6

3. Learned counsel for the petitioner submitted that the petitioner is a senior citizen who is a retired headmistress and she had nothing to do with the alleged offenses. In fact, it was all the first accused, that is her late husband who had been living separated from her since 2010, who had indulged in such activities with the company of the third accused, who is none other than the paramour of her husband. However, the petitioner has no role to play in the alleged offences and sought for the indulgence of this Court to quash the final report.

Learned Government Advocate(Crl.side) categorically contended at that it is only the petitioner who was first arrested at the instance of the complaint received from the de facto complaint and only based on her statement later the third accused was implicated. The petitioner was arrested and after an investigation, a final report has been laid as against all the three accused. The first, second and third accused together who have interest in the fraudulent act of deceiving the defecto complainant and five others have received money in the guise of obtaining job for them and accordingly sought for dismissal of this 3/6

petition.

5. Heard both sides and perused the materials available on record.

6. The final report has been laid for the offenses under sections 406, 420, 120B and 34 of IPC as against the accused therein. A careful reading of the charge sheet would make it clear that the offenses under Section 406, 420, 120B and 34 of IPC, are clearly made out. Hence, this Court do not intend to interfere with the case.

7. Accordingly, this Criminal Original Petition is dismissed. However, the learned Judicial Magistrate No.1, Madurai, is directed to expedite the trial as early as possible, not later than within a period of six months from the date of receipt of a copy of this order.
