ORDER

This Criminal Original Petition is filed seeking to quash the first Information Report in Crime No.360 of 2016, on the file of the first respondent Police, which was registered for the offences under Sections 296(b), 115(2), 118 (1), 351(2) / (3) of BNS and corresponding offences under Section 294(b), 323, 324 and 506 (ii) of IPC.

2. The gist of the allegations is that when the de facto complainant was standing before her house, due to previous enmity a wordy quarrel arose between the petitioners. On hearing the noise, the de facto complainant's son immediately came out of the house and at that time the petitioners attacked the de facto complainant and her son with wooden log and further threatened them with dire consequences. Hence, the present complaint.

3. Admittedly, the petitioners and the second respondent are residing in the same village and they have now entered into a compromise and decided to give a quietus to the entire dispute. The parties have filed a joint compromise memo dated 18.12.2025. 2/6

4. The petitioners and the second respondent / defacto complainant are present before this Court in person. They are identified by Mr.A.Jeya Kumar, Sub Inspector of Police, B1 Melur Police Station, Melur. The defacto complainant does not wish to pursue the said F.I.R as against the petitioner. All the parties confirmed the compromise arrived at between them.

5.Considering the nature of the allegations and the relationship between the parties, this Court is of the view that no useful purpose would be served by keeping the impugned FIR pending investigation. Accordingly, the impugned FIR in Crime No.360 of 2016 is quashed in entirety and the Criminal Original Petition stands allowed. The petitioners are directed to produce a demand draft of Rs.10,000/-(Rupees Ten Thousand only) in favour of the victim, within a period of one week from today, failing which, the criminal original petition stands automatically dismissed. The joint compromise memo dated 18.12.2025 shall form part and parcel of the order.

6.The petitioners are directed to file a memo along with the photocopy of the receipt before the Registry on or before 12.01.2026. List the matter on 20.01.2026, for reporting compliance. 19.12.2025 (2/2) Index: Yes/ No Speaking Order / Non-Speaking Order rgm 4/6
