this Hon'ble Court in Crl MP(MD) No.12963/2025 in Crl A(MD) No. 751/2025 vide its order dated 24.09.2025, pending disposal of the Criminal Appeal.
ORDER
This Petition is filed to relax the condition imposed by this Court in Crl.MP(MD) No.12963/2025 in Crl A(MD) No.751/2025 vide its order, dated 24.09.2025.
2.The Petitioner is the third accused and was found guilty and convicted for the offence under Section 307(2) of IPC and sentenced to undergo 10 years rigorous imprisonment and to pay a fine of Rs.5,000/-, in default, to undergo six months rigorous imprisonment by the learned Sessions Judge, Tuticorin. The Petitioner earlier filed suspension of sentence application in Crl.M.P(MD)No.8997 of 2025 and this Court allowed the application by imposing conditions stated therein. The Petitioner filed a second application in Crl.M.P(MD)No.12963 of 2025 and prayed for relaxing the condition No.2 in the order, dated 8.8.2025.This Court vide order dated 24.09.2025 relaxed the condition No.2 to the following effect:

''4.Considering the above, the condition imposed on the Petitioner in Crl.M.P(M)No.8997 of 2025 in Crl.A(MD)No.751 of 2025 dated 8.8.2025 is modified to the effect that the Petitioner is directed to appear before the concerned court in alternative weeks ie., on the first and third Monday of every month at 10.30 a.m until further orders.'' 3.The Petitioner has now filed the present application seeking further relaxation of the condition on the ground that the Petitioner finds it difficult to comply with the order as he was unable to continue his work and his employment opportunities were affected. In the facts and circumstances, this Court is inclined to modify the condition imposed by this Court on 24.09.2025 to the effect that the Petitioner shall appear before the concerned Court in the first working day of every English Calendar month at 10.30 a.m until further orders. 4.The Criminal Miscellaneous Petition is accordingly allowed. 08-01-2026 vsn 3/5
