ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 17.11.2025 for the offences punishable under Sections 406 and 420 of IPC, in Crime No.276 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner, along with the other accused, received a sum of Rs.6,55,000/- from the defacto complainant on the pretext of securing employment for him in Singapore. However, they neither secured the job nor returned the said amount. Hence, the complaint

3. The learned counsel for the petitioner submitted that the petitioner has submitted a sum of Rs.2,50,000/-. He further submitted that the petitioner is in judicial custody from 17.11.2025. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that that petitioner, along with the other accused, received a sum of Rs.6,55,000/- from the defacto complainant on the pretext of securing employment for him in Singapore. However, they neither secured the job nor returned the said amount.

Considering the fact that the petitioner has deposited a sum of Rs.2,50,000/- and since the petitioner has complied with the condition imposed in the interim bail, the interim bail already granted is made absolute and this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail with certain conditions.

[a] the petitioner shall report before the respondent police as and when required for interrogation. [b] the petitioner shall not tamper with the evidence or witness either during investigation or trial. [c] the petitioner shall not abscond either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
