ORDER

This writ petition has been filed seeking Mandamus directing the respondent police to consider, enquire into and dispose of the petitioner's complaint dated 17.11.2025 and 10.12.2025 within a time that may be stipulated by this Court.

2. The contention of the petitioner is that there is a civil dispute pending between the petitioner and one Sudar Rajan and Saminathan, husband of the third respondent in O.S.No.865 of 2023. While that being so, the third and fourth respondents waylaid the petitioner and threatened him to withdraw the suit. When the petitioner denied to withdraw the suit, wordy quarrel arose. Thereafter, they have taken the petitioner's two wheeler and cash of Rs. 50,000/-. Therefore, the petitioner preferred a complaint on 17.11.2025 at 08.59 pm., via online. As a counterblast, the third and fourth respondents preferred a complaint on 18.11.2025 alleging that the petitioner has attacked the respondents 3 and 4 as well as said Saminathan.

3. The learned Government Advocate (crl.side) appearing for the respondents 1 and 2, on instructions, submitted that the alleged vehicle is standing in the police station, based on the complaint preferred by the third and fourth respondents.

4. When there are rival complaints, the respondent police ought to have given due importance to both complaints and ensured that the dispute between the parties was not aggravated. The conduct of the respondent police is deprecated. Therefore, the respondent police is directed to take appropriate action on both complaints, strictly in accordance with law. It is further advised that the respondent police shall not take sides in the dispute between the parties.
