ORDER

Seeking a direction to the respondents 1 and 2 to provide adequate police protection to the life and limb of the petitioner and his family members, based on the petitioner's representations dated 12.12.2025 and 13.12.2025, this petition is filed.

2.Considering the limited scope of the relief sought for, notice to the respondents 3 to 8 is dispensed with.

3.The learned counsel appearing for the petitioner submitted that the petitioner owns a small house situated at No.73, Jegannathan Compound, Chemmangudi Road, Nagarcoil, Kanyakumari District. The respondents 3 to 8 own commercial complex in the plot adjacent to the petitioner's house. For the purpose of expanding their business, the respondents 3 to 8 are trying to grab the petitioner's property by forcibly evicting them. Despite the petitioners complaint to the second respondent police, no steps have been taken in this regard and hence, he sought the indulgence of this Court. 2/5

4.The learned Government Advocate (Crl. Side) on instructions, submitted that this is the second application made by the petitioner before this Court and earlier this Court passed an order in favour of the petitioner and pursuant to the same, the second respondent Police called both the parties for enquiry. But, during the enquiry, the petitioner had not given any cooperation for the proper conduct of the enquiry and only because of his non cooperation, the second respondent police is unable to deal with the matter. 5.Per contra, the learned counsel appearing for the petitioner categorically contended that the petitioner was not at all called for enquiry by the second respondent Police at any point of time. 6.Heard the learned counsels on either side and carefully perused the materials available on record.

7.Considering the submission made on either side, this Court directs the second respondent to conduct enquiry and take necessary steps in accordance with law. The petitioner as well as the respondents 3 to 8 are directed to appear before the second respondent Police as and when required. In view of the relief 3/5

granted notice to R3 to R8 is dispensed with. 8.With the above directions, this Criminal Original Petition stands disposed of.
