ORDER : The Court made the following order :- The petitioner, who arrayed as accused, was arrested and remanded to judicial custody on 25.11.2025 for the offences punishable under sections 7 r/w. 8 of POCSO Act, 2012 in Crime No.35 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner herein, who is aged about 68 years, has sexually assaulted the victim girl, aged 17 years. Hence, the compliant.
3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he is in judicial custody from 25.11.2025 and seeks bail.
4. The learned Additional Public Prosecutor appearing for the respondent would submit that the petitioner has sexually assaulted the victim girl victim girl, aged about 17 years and the investigation of the 2/4
case is pending and hence, he strongly opposed to grant bail to the petitioner.
5. This Court has perused the statement of the victim recorded under Section 164 Cr.P.C., and the same does not support the case of the petitioner. Further, considering that the petitioner was holding the position of a teacher and also taking into account the serious nature of the allegations made against him, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. (S S Y J) 18.12.2025 TRP TO
