ORDER : The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 06.02.2025 for the offences punishable under Sections 69 and 318(2) of BNS, 2023, in Crime No.57 of 2023 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and the defacto complainant loved each other and had physical relationship. Subsequently, she became pregnant. However, the petitioner refused to marry her. Hence, the complaint.

3. The learned Counsel for the petitioner submitted that the petitioner solemnized his marriage with the defacto complainant on 13.02.2026 at Sri Muthumariamman Temple, Keeramangalam. Hence, he seeks bail to the petitioner.

4. The learned Additional Public Prosecutor submitted that the 2/6

petitioner solemnized his marriage with the defacto complainant on 13.02.2026, however, the same has not been registered.

5. The petitioner solemnized his marriage with the defacto complainant on 13.02.2026 at Sri Muthumariamman Temple, Keeramangalam. The said temple has issued a marriage receipt dated 13.02.2026. However, the petitioner is directed to register the marriage within a period of two months from the date of receipt of a copy of this order. Considering the above facts and also considering the period of incarceration suffered by the petitioner, the interim bail already granted is made absolute and this Court is inclined to grant bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail with certain conditions.

[a] the petitioner shall report before the respondent police and when required for interrogation. In case, if the petitioner fails to submit the marriage certificate, the prosecution is at liberty to move an application for cancellation of bail.

[b] the petitioner shall not tamper with the evidence or witness either during investigation or trial. [c] the petitioner shall not abscond either during investigation or trial.

[d] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[e] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
