ORDER : This Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 318(4) of B.N.S. Act and 34 of National Medical Commission Act, in Cr.No.535 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner is not having any valid qualification for providing treatment under the medical commission Act. IN this situation, the petitioner conducted the abortion to one female. Thereafter, she went to Government Hospital for further treatment. The above said woman was enquired by the medical officials at that time, she told that the primary treatment was given by the petitioner. Hence, this case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence and she has been falsely implicated in this case. Hence, he seeks bail.

4. The learned Additional Public Prosecutor for the respondent submitted that the investigation is at initial stage and if the petitioner is released on bail, 2/4

she may abscond. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Considering the facts and circumstances of the case and also the nature of the offence committed by the petitioner and considering that the investigation is still pending, if the petitioner is released on bail, she may tamper the witnesses and abscond. Hence, this Court is not inclined to grant bail to the petitioner.
