ORDER
The petitioner has approached this Court seeking a direction to the respondent to pay the amount towards the encashment of 26 days of earned leaves surrendered by him in the years before his retirement either based on his monthly wages of the respective months of surrender of those earned leaves, together with 18% interest p.a. from the respective due dates or based on the monthly wages payable on the month of his retirement, together with 18% interest from the date of retirement, within a time frame.
2.The case of the petitioner is that he joined as a Tradesman in the respondent Transport Corporation on 17.12.1979 and retired from service as Special Grade Tradseman on 31.01.2015. According to him, he has rendered 35 years of service and he is entitled for encashment of earned leave. However, surrendered leave for a period of 26 days has not been calculated and has not been settled and therefore, the petitioner has submitted a representation and filed the present writ petition.

3.Learned Standing Counsel appearing for the respondent submits that in the event, if the petitioner is eligible, it would be calculated and disbursed to the petitioner.
4.This Court paid its anxious consideration to the rival submissions made and also perused the materials placed on record. 5.Admittedly, the petitioner has rendered 35 years of service and retired from service on 31.01.2015. While calculating the retirement benefits, it appears that the earned leave surrendered by the petitioner has not been calculated properly. Therefore, this Court directs the respondent to calculate the earned leave salary properly, in the event, if the petitioner is eligible for surrender of earned leave salary, the respondent shall properly calculate the eligible amount and disburse the same together with 6% interest, from the date of retirement till the date of actual disbursement, within a period of eight [8] weeks from the date of receipt of a copy of this order. Accordingly, this writ petition is allowed. There shall be no order as to costs. 19.12.2025 gns 3/5
