ORDER : The Court made the following order :- The petitioner, who arrayed as accused, was arrested and remanded to judicial custody on 29.10.2025 for the offences punishable under sections 351(2) of BNS, 2023 and Sections 5(n), 5(l), 5(j) (ii)r/w 6 (1) of POCSO Act, in Crime No.17 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner and A1 have sexual intercourse with the victim girl, who is aged about 15 years old. Hence, the compliant.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has not committed any offence as alleged by the prosecution and he is in judicial custody from 29.10.2025 and seeks bail.

4. The learned Government Advocate (Crl. side) appearing for the respondent would submit that the victim is 15 years at the time of occurrence and she got pregnant and a girl child was born. Based on DNA test, the first accused is confirmed as biological father. However, the petitioner is also having active role and he has also committed penetrative sexual assault against the victim girl, who was 15 years old. Hence, he strongly opposed to grant bail to the petitioner.

5. Considering the facts and circumstances of the case and the allegation made against the petitioner is heinous in nature, this Court is not inclined to grant bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed.
