ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 420, 406, 120B, 109, 323, 506(i), 211 IPC, in C.C.No.173 of 2023 on the file of the Judicial Magistrate, Theni, seeks anticipatory bail. 1/4

2.The learned counsel appearing for the petitioner submitted that the petitioner is working in Central Reserve Police Force (CRPF), due to work, the petitioner was unable to appear before the trial Court, hence, the trial Court has issued an NBW against the petitioner. He further submitted that the petitioner is ready and willing to abide by any stringent conditions that may be imposed by this Court. Hence, he seeks to grant anticipatory bail to the petitioner. 3.The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature.

4. Considering the facts and circumstances of the case, this Court directs the petitioner to surrender and submit a recall petition before the Judicial Magistrate, Theni. Upon such a petition being filed, the Judicial Magistrate, Theni, shall consider the petition in accordance with the law on its merits on the same day.

5. With the above said directions, the Criminal Original Petition is disposed of.
