PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to provide adequate police protection to petitioner and petitioner's family members at the time of cremation of dead body of the petitioner's mother Ramaiyee based on petitioner representation submitted to the 3rd respondent on 10.12.2025. ORDER

The petitioner has filed this writ petition seeking to provide police protection for cremation of his mother. There is previous enmity between the petitioner and the private respondent. The private respondent is also refusing to attend the cremation ceremony which is to be conducted in the petitioner's new house.

2. The learned counsel appearing for the petitioner submits that he wants a decent premises to the petitioner's mother.

3. Considering the rival submissions, this Court is inclined to pass the following orders:- a) The petitioner is permitted to keep the body in the petitioner's new house and carry the rituals. Thereafter, shall keep the body to the old house for half an hour. The private respondent herein shall pay the last homage there. Thereafter, the body shall be taken for cremation. For the above activities, the respondent police shall give the adequate police protection. The private respondent is at liberty to attend the new house also, but the same is left open for the private respondent.

4. With the above said directions, this writ petition stands disposed of. No costs.
