ORDER
The petitioner is accused No.1 in SplSC.No.27 of 2025 on the file of the I Additional District and Sessions Judge (PCR), Tiruchirappalli. He was tried along with other accused and by judgment dated 21.11.2025 the petitioner has been found guilty, convicted and sentenced as follows:

As against the conviction and sentence imposed by the trial Court, the petitioner has filed an appeal before this Court in Crl.A(MD)No.1372 of 2025 and the same has been admitted by this Court. The petitioner along with the appeal has also moved this petition to suspend the sentence.
2.The learned counsel for the petitioner submits that the accused Nos.3 and 4 have also filed criminal appeal in Crl A(MD)No.1381 of 2025 along with Crl(MD)No.20559 of 2025 to suspend the sentence. This court by order dated 05.03.2026 has also suspended the sentence. The trial court has granted suspension of sentence and it has also been extended by this court periodically. 3.The learned Government Advocate appearing for the State submits that A1 and A2 are having specific overt act and they are having previous motive.
4.The learned Legal Aid counsel appearing for the defacto complainant submits that he stands on his complaint. 3/6
5.Considering that the co-accused has been granted suspension of sentence by this court and considering that the appeal could not be taken up for final hearing for want of time, this Court is inclined to allow this petition.
6.Accordingly this petition is allowed and the substantive sentence of imprisonment imposed on the petitioner alone is suspended pending disposal of the criminal appeal on the following conditions:
(i) The petitioner is ordered to be enlarged on bail on executing a bond for Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties each for a like sum, to the satisfaction of the I Additional District and Sessions Judge (PCR Cases), Trichy. (ii) The petitioner shall file an affidavit before the respondent police that he will not misuse this liberty and will not indulge in any further offence. 4/6
(iii) The petitioners shall report before the respondent police daily at 10.30am.
(iv) If the petitioner violates any of the conditions, the respondent police shall move an application to cancel the order of suspension of sentence of imprisonment.
