O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to pass appropriate orders for issuance of a separate patta in the petitioner's name in respect of the property comprised in Survey No.30/9, measuring an extent of 16 cents, situated at Ponnavarayankottai, Pattukottai Taluk, Thanjavur District, by subdividing and demarcating the same, in the light of the petitioner's appeal dated 25.05.2025 in No.2025/N105/21/004707, within the stipulated time as may be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that there were certain ancestral properties and that the subject property was allotted to the petitioner at the time of partition; that under the UDR Scheme, the name of one Pappa Thevar was included in the joint patta; Page No. 2 of 5

that therefore, the petitioner submitted an application dated 20.01.2025 to the third respondent seeking subdivision and demarcation of the property and issuance of a separate patta, along with chitta and other relevant documents; that since there was no response from the third respondent, the petitioner preferred an appeal dated 25.05.2025 before the first respondent seeking cancellation of the joint patta and issuance of a separate patta in respect of the subject property; that the petitioner's appeal is pending without any progress; and that therefore, the petitioner was constrained to file the present Writ Petition.

4. The learned Special Government Pleader appearing for the respondents would submit that the petitioner's appeal would be considered and disposed of within a period of eight weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to consider the petitioner's appeal dated 25.05.2025 on its merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. The appeal shall be considered and disposed of after Page No. 3 of 5

conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner and any other interested parties who may be affected by the decision. If necessary, the subdivision and demarcation shall be carried out after issuing notice to all interested parties. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. There shall be no order as to costs.
