PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents herein to pass an Award and pay additional compensation, solatium and interest amount in respect of the acquisition of petitioner's landed properties comprised in Survey Numbers.43/1C of an extent of 0.36.1 Hectares, 43/1D1 of an extent of 0.30.5 Hectares and S.No. 43/1D2 of an extent of 0.40.5 Hectares, situated at Mayanoor Village, Krishnarayapuram Taluk, Karur District and to pay compensation for loss of coconut trees in accordance with the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013 based on the notification issued by the first respondent herein in Rc.No.C2/17641/2008, dated 11.01.2023.

ORDER
The petitioner is the absolute owner of the properties in question. Acquisition proceedings were initiated in the year 2018. The notification was published on 11.01.2023 under Section 11(1) of the Act of 2013. The petitioner relies upon multiple communications with regard to the issuance of an Award and payment of compensation. In spite of lapse of considerable period of time, it is stated that the award has not been issued and compensation has not been paid.
2. The learned Special Government Pleader accepts notice on behalf of the respondents 1 to 4. He submits that the matter is pending before the Principal Secretary, Finance Department and that about six months is required to complete the process.
3. The position that emerges on examining the affidavit and documents is that the petitioner is not in a position to use his land in view of the acquisition proceedings. He has also not received any compensation till date. In these circumstances, it is just and necessary that action be taken on an expeditious basis to issue an award and pay compensation.
4. Accordingly, the respondents 3 and 4 are directed to issue the award and disburse the compensation to the petitioner for the acquisition of his lands within three (3) months from the date of receipt of a copy of this order.
