ORDER

The writ petitioner P.Rajesh Kumar, an employee of the Transport Corporation, had filed a writ petition before this Court in W.P.(MD)No. 22728 of 2015, challenging the order of dismissal passed by the respondent. This Court, by order dated 17.12.2015 in W.P.(MD)No. 22728 of 2015, allowed the writ petition, setting aside the order of dismissal and directed the respondent to pay wages for the period of nonemployment along with other benefits. However, the order of this Court has not been complied with by the respondent. Therefore, the writ petitioner has submitted a representation before the respondent and also filed another writ petition in W.P.(MD)No.13312 of 2017 seeking disbursement of the benefits as ordered by this Court. Considering the facts and circumstances of the case, this Court directed the respondent to consider the representation of the writ petitioner. However, the 2/6

respondent, by order dated 22.09.2025, rejected the writ petitioner's representation holding that he is not entitled for salary during the period which he had not worked. Therefore, he has filed the present writ petition in W.P.(MD)No.27942 of 2025. This Court, taking note of the fact that there has been a positive direction given to pay wages for the period of non-employment and the same has not been complied with, which is contemptuous of the order of this Court dated 17.12.2015, in W.P.(MD)No.22728 of 2018, directed the respondent to forthwith comply with the directions given by this Court in W.P.(MD)No.22728 of 2015 and ensure that the writ petitioner is paid the wages for nonemployment period on or before 21.11.2025.

2. Thereafter, when the matter was taken up for reporting compliance on 24.11.2025, it was reported that the petitioner was not paid with wages. Therefore, this Court, by its order dated 24.11.2025, directed the Registry to take suo motu contempt proceedings as against the respondent and issue statutory notice to the respondent. Accordingly, this suo motu contempt petition has been initiated and it is listed today. 3/6

In response to the suo-motu contempt petition, the learned Additional Advocate General, by referring to the proceedings of the General Manager dated 30.12.2025, submits that the earlier order issued by the respondent dated 04.08.2016 has been modified by a proceedings dated 30.12.2025 that the writ petitioner has been re-instated with continuity of service and backwages. The learned Additional Advocate General further submits that pursuant to the proceedings of the General Manager dated 30.12.2025, a sum of Rs.36,88,206/- towards wages for non-employment period and salary arrears has been settled to the writ petitioner vide Cheque No.047883 dated 31.12.2025. A copy of the proceedings dated 30.12.2025 and acknowledgment of the petitioner for receipt of the cheque No.047883 dated 13.12.2025 are also placed before this Court.

4. The learned counsel for the writ petitioner seeks a short accommodation to ascertain the same from the writ petitioner. 4/6

5. In view of the proceedings dated 30.12.2025 and also the acknowledgment of the petitioner for receipt of the service benefits, dated 31.12.2025, this suo-motu contempt petition is closed. 02.01.2026 ogy Index : Yes / No.
