O R D E R
The present Writ Petition has been filed by the Hereditary Trustee of Arulmighu Suyambhulinga Swamy Temple seeking a Mandamus as against the second respondent to cancel the registration of the first respondent Sangam on the ground that the first respondent Sangam has been created in the name of the temple and they are collecting donation in the name of the temple.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself. Since no adverse order is going to be passed as against the first respondent, notice to the first respondent is dispensed with.
3. According to the learned counsel appearing for the Writ Petitioner, the temple is under the control of the HR & CE Department 2/4
and he is the Hereditary Trustee for the said Temple. The first respondent cannot start a Society using the name of the temple and collected funds in the name of the temple. Complaining about the same, he has given a representation before the second respondent on 18.06.2025. So far no steps have been taken to conduct enquiry. Hence, the present Writ Petition.
4. Considering the above said facts, the second respondent is directed to conduct enquiry after giving opportunity to the Writ Petitioner and the first respondent and pass orders within a period of twelve (12) weeks from the date of receipt of a copy of this order.
5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
