O R D E R

This Writ Petition is filed seeking a Mandamus as against the respondents to pay excess stamp duty collected from petitioner, while registering a release deed dated 18.01.2024 by the 3rd respondent, which is in violation of Article 55(A) schedule I of the Registration Act.

2. It is the case of the petitioner that the petitioner's brother has executed a release deed in favour of the petitioner. The release deed should be valued as per Article 55(A) of the Registration Act. But the 3rd respondent has treated it as sale deed and collected 7% of stamp duty. As per Article 55(A) of the Registration Act, the petitioner has to pay only Rs.21,933/- as stamp duty. Hence, the petitioner made a representation on 21.01.2025, seeking to pay excess stamp duty collected from the petitioner. Since the same was not considered, the petitioner has filed this Writ Petition.

3. The learned Additional Government Pleader appearing for the respondents would submit that the representation of the petitioner dated 21.01.2025 would be considered in accordance with law. 2/4

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the respondents to consider and pass orders on the representation of the petitioner dated 21.01.2025 on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
