Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Certiorarified Mandamus calling for the records relating to the impugned refusal slip in RFL/Bodinayakanur/2/2025 dated 22.01.2025 issued by the respondent and quash the same as illegal and consequently direct the respondent to register the rectification deed presented by the petitioner within the time stipulated by this Court. ORDER

This Writ Petition has been filed challenging the impugned refusal slip in RFL/Bodinayakanur/2/2025 dated 22.01.2025 issued by the respondent and consequently direct the respondent to register the rectification deed presented by the petitioner.

2. Mr.K.S.Selvaganesan, learned Additional Government Pleader takes notice for the respondent.

3. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.

The learned counsel appearing for the petitioner would submit that the respondent refused to register the document presented by the petitioner citing the reasons of (i) the Judgment in O.S.No.55 of 2014 on the file of the learned District Munsif cum Judicial Magistrate, Bodinayakanur, dated 29.01.2025, (ii) the subject properties are covered under PACL and hence, registration is barred as per the circular issued by the Inspector General of Registration, (iii) an agreement was registered between third parties in Document No.4446/2014 and (iv) patta stands in the name of one Kalidas and he has executed a power deed in Document No.512 of 2017. Hence, the Writ Petition.

5. Upon perusal of the impugned refusal slip issued by the respondent and the reasons stated therein, this Court is not inclined entertain this Writ Petition, since factual aspects are involved and the same have be agitated before the Civil Court.

6. In view of the same, this Writ Petition is dismissed. No costs. The petitioner is at liberty to approach the Civil Court for appropriate remedy, if she is so advised.
