ORDER
The present writ petition has been filed seeking to quash the order passed by the second respondent wherein the request of the writ petitioner for providing service connection has been rejected on the ground that there are arrears.
2. According to the learned Counsel appearing for the writ petitioner, the petitioner's vendor had dues with the respondent TANGEDCO and the same was not paid. When the dues were demanded along with belated payment surcharge, the petitioner's vendor had filed a writ petition in W.P.(MD)No.17711 of 2024 seeking to provide service connection which was disconnected due to non-payment of charges. This Court has passed order on 19.08.2024, wherein the current charges were upheld but the belated payment surcharge was set aside. Challenging the same, the TANGEDCO had filed W.A.(MD)No.898 of 2/4
2025 which is pending before the Hon'ble Division Bench. In view of the above said non-payment of BPSC by the vendor of the petitioner, so far the service connection has not been effected to the writ petitioner. Hence the present writ petition.
3. I have considered the submissions made on either side and perused the materials available on record.
4. Considering the fact that as on today, the order of the Writ Court is in favour of the writ petitioner's Vendor, the respondent TANGEDCO cannot demand BPSC. Therefore, there shall be a direction to the respondents to give fresh service connection to the writ petitioner subject to the result of the Writ Appeal. The service connection shall be provided within a period of 4(four) weeks from the date of receipt of application and on payment of necessary charges without insisting upon BPSC. No costs.
5. With the above said observations, this Writ Petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are also closed. 23.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 3/4
