O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to issue patta in favour of the petitioner in respect of the petitioner's property bearing Door Nos.160 and 161A in T.S.No.836/1A1, Palayam, Palani Town, Dindigul District, based on the petitioner's representations dated 24.07.2024 and 23.08.2024, within the time frame to be stipulated by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The case of the petitioner is that the subject property has been declared as the property of the petitioner and a permanent injunction was granted in favour of the petitioner vide Judgment and Decree dated 07.07.2018, passed by the learned Additional District Judge (Fast Track Court), Palani, in A.S.No.69 of 2017; that there has been no challenge to the said order till date; that the petitioner and his sons submitted a Page No. 2 of 5

representation dated 24.07.2024 to the second respondent for issuance of patta; that however, the second respondent has not considered the same; that therefore, they submitted a representation dated 23.08.2024, which also did not evoke any response; and that therefore, the petitioner was constrained to file the present Writ Petition.

4. The learned Additional Government Pleader appearing for the respondents would submit that the petitioner's representations dated 24.07.2024 and 23.08.2024 would be considered and appropriate orders would be passed within a period of twelve weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representations dated 24.07.2024 and 23.08.2024 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representations shall be considered and disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner and any other interested parties who Page No. 3 of 5

may be affected by the decision. The aspect of the earlier civil suit and the appeal shall be taken into consideration while disposing of the said representations.
