Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned Government Order in G.O No.195 Home (Police XIX) dated 08.03.2024, published in the Tamil Nadu Government Gazette on 27.03.2024 and quash the same as illegal as far as the property assigned to the petitioner's father through DKT Patta No.1216 of 1979 bearing Survey No.561 to an extent of 4 acres 51 cents situated at Aadhanur Village, Vadipatti Taluk, Madurai District, is alone concerned and consequently direct the second respondent to hand over the property to the petitioner's father. ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned Government Order in G.O No.195 Home (Police XIX) dated 08.03.2024, published in the Tamil Nadu Government Gazette on 27.03.2024, as illegal as far as the property assigned to the petitioner's father through DKT Patta No.1216 of 1979 bearing Survey No. 2/6

561 to an extent of 4 acres 51 cents situated at Aadhanur Village, Vadipatti Taluk, Madurai District, is concerned and consequently direct the second respondent to hand over the property to the petitioner's father.

2. Admittedly, the fifth respondent is the original owner of the property and had sold the same to the fourth respondent. The fourth respondent committed some financial frauds. Therefore, the victim had preferred a complaint. Thereafter, the case is pending before the TNPID Court. The Government, after following all the procedures, issued the present Government Order.

3. The contention of the petitioner is that the DKT patta covers an extent of 4 acres and 51 cents. The said pata was issued only for cultivating purpose alone.

4. The petitioner cannot claim right over the property when he is having only cultivating rights. On this ground, the present writ petition cannot be entertained. Moreover, when the matter is pending before the TNPID Court, no other Court has jurisdiction to entertain any petition in respect of the same subject matter. Therefore, the present writ petition is not maintainable. 3/6

5. Accordingly, this writ petition is dismissed. No Costs. Consequently, connected miscellaneous petition is closed.
