A.N.Ramanathan Prayer: Transfer Civil Miscellaneous Petition filed under Section 24 of Civil Procedure Code to pass an order in O.S.No. 118 of 2018 the file of the Learned District Court, Karur and transfer the same to the any other District Court and thus render justice.

ORDER

The transfer civil miscellaneous petition invoking Section 24 of CPC for withdrawing the suit in O.S.No.118 of 2018 on the file of the District Court, Karur and transfer the same to the any other District Court . 4/8

2. The petition for transfer is premised on the basis that the Presiding Officer has expressed his opinion on the subject matter and during the course of trial, he has been constantly interjecting and putting leading questions, which, according to the petitioners, lends them to believe that the trial may not be fair.

3. Learned counsel for petitioners submits that the atmosphere during the hearing of the suit is hostile, intimidating and depriving the petitioners of fair and impartial trial.

4. He further submits that petitioners only requires the Presiding Officer to give him a fair and reasonable opportunity to cross-examine the defence witnesses and not to record the deposition of witnesses improperly.

5. This Court does not propose to get into the merits of the allegations. However, the request of petitioners appears to be reasonable.

6. In view thereof, the transfer petition is disposed of with a direction to the learned District Judge, Karur to afford a reasonable opportunity to the petitioners to cross-examine the defence witnesses, ensure that the depositions 5/8

are recorded fairly and transparently and decide the matter independent and in an unbiased manner. Since no adverse orders are to be passed against the respondents, notice to them are dispensed with.
