O R D E R

The present Writ Petition has been filed seeking a Mandamus as against the second respondent herein to delete the entry made in the Encumbrance Certificate.

2. By consent, this Writ Petition is taken up for final disposal.

3. According to the learned counsel appearing for the petitioner, in view of the orders passed by the first respondent herein cancelling the settlement deed, she had challenged the same in W.P. (MD)No.3989 of 2025 and the same was allowed on 24.03.2025. Therefore, encumbrance should be deleted by the second respondent.

4. A perusal of the order in W.P.(MD)No.3989 of 2025 reveals that though Writ Petition has been allowed, it has been remitted back to the file of first respondent herein for fresh consideration. In such circumstances, it would not be appropriate to issue a direction to the second respondent to delete the entry in the Encumbrance Certificate. 2/4

5. In view of the above said facts, the first respondent is directed to complete the enquiry and pass orders within a period of two

(2) months from the date of receipt of a copy of this order.
