This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first to third respondents to issue suitable directions to the fourth respondent to comply with the order of this Court Page No. 2 of 6
passed in W.P.(MD) No.22112 of 2021 dated 21.11.2023, based on the petitioner's representation dated 27.11.2025.
2. In the earlier writ petition in W.P.(MD) No.22112 of 2021, this Court, by order dated 21.11.2023, directed the petitioner to submit an application to the fourth respondent, the Tahsildar, along with all relevant documents and further directed the fourth respondent, the Tahsildar, to act upon the representation dated 12.05.2021.
3. The present Writ Petition has now been filed seeking the very same relief, in view of the representation dated 27.11.2025.
4. The learned counsel for the petitioner would submit that pursuant to the order passed by this Court on 21.11.2023 in W.P.(MD) No.22112 of 2021, the fourth respondent, the Tahsildar, failed to act upon the same resulting in the sale of the property and a change in the rights over the property.
5. In the event of any violation of the order of this Court dated 21.11.2023 in W.P.(MD) No.22112 of 2021, it is open to the petitioner to Page No. 3 of 6
file a contempt petition. Without resorting to the said remedy, the filing of a fresh writ petition on the ground that the petitioner has again submitted a representation dated 27.11.2025, since the earlier representation was not considered, cannot be entertained. Further, if there is any change in the ownership of the property, the petitioner is always at liberty to challenge the same before the competent civil court.
6. With the above observations, this Writ Petition stands disposed of. No costs.
