ORDER
This petition has been filed to relax the condition dated 25.04.2025 imposed on the petitioner by this Court in Crl MP(MD)No.4706 of 2025 in Crl.A(MD)No.428 of 2025.
2. The petitioner is the sole accused in Spl.S.C.No.32 of 2023 on the file of the learned Sessions Judge, Fast Track Mahila Court, Dindigul, Dindigul District. The petitioner was charged with offence under Section 363 of IPC and Section 5(1) r/w 6 of POCSO Act and convicted to undergo rigorous imprisonment for five years and to pay a fine of Rs.5,000/-, in default to undergo simple imprisonment for six months. The petitioner is also convicted for offence under Section 6 of POCSO Act to undergo rigorous imprisonment for twenty years and to pay a fine of Rs.10,000/-, in default to undergo simple imprisonment for six months. The setence was directed to run concurrently.
3. The petitioner aggrieved by the judgment of the Trial Court filed the above appeal. On 25.04.2025, this Court suspended the sentence in Crl.M.P(MD)No.4706 of 2025 by imposing a condition that the 2/5
petitioner shall stay at Tiruppur and report before the Inspector of Police, Tiruppur North Police Station, daily at 10.30a.m., till the disposal of the appeal.
4. The petitioner states that he is facing lot of hardships and prejudice because of the condition imposed by this Court. Therefore, he prayed to relax the above condition.
5. Considering the facts and circumstances of the case, this Court is inclined to relax and modify the condition No.iii imposed by this Court in Crl.M.P(MD)No.4706 of 2025 dated 25.04.2025 to the effect that the petitioner shall stay at Tiruppur and report before the Inspector of Police, Tiruppur North Police Station on every monday of the week at 10.30 a.m., instead of daily at 10.30 a.m., till the disposal of the appeal. The petitioner shall also not enter into the jurisdiction of the Dindigul District. Accordingly, the petition is allowed. 06.01.2026 SN 3/5
