O R D E R

This Writ Petition is filed directing the respondents 2 and 3 to conduct the survey and fix the four boundaries in respect of Sy.No. 17/28 (Old Sy.No.17/3B1AA) measuring 11.20 Ares based on the petitioner's application No.2024/0123/13/0006901 dated 14.10.2024.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel for the petitioner would submit that the property is an ancestral in nature. With a view to properly identify the boundaries and avoid future disputes, the petitioner submitted an online application No.2024/0123/13/0006901 dated 14.10.2024 before the competent revenue authorities seeking survey the land and fix the four 2/6

boundaries of the said land. Despite the said application, the official respondents have failed to take any action to survey the land and fix the four boundaries of the petitioner's land within a reasonable time. Hence, the petitioner has been constrained to approach this Court by filing the present Writ Petition.

4. The learned Government Advocate appearing for the respondents would submit that proper steps would be taken to survey the land and fix the four boundaries in accordance with the law.

Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the respondents 2 and 3 to consider the petitioner's application dated 14.10.2024, on merits and in accordance with law and pass appropriate orders within a period of sixteen (16) weeks from the date of receipt of a copy of this order. The application shall be considered and disposed of after conducting an enquiry. The respondents 2 and 3 are directed to provide reasonable opportunity during such enquiry to the petitioner and also to the other persons, who may be affected by such decision. It is needless to state that the revenue officials may seek 3/6

assistance from the Police, if Police assistance is required while carrying out such survey. In the event of any rival claims, the parties are at liberty to work out their remedies before the Civil Court. There shall be no order as to costs.
