ORDER

The present petition has been filed seeking to quash the charge sheet in C.C.No.92 of 2025 on the file of the District Munsif Cum Judicial Magistrate Court, Ilaiyangudi, Sivagangai District in Crime No.190 of 2025 on the file of the Inspector of Police, Ilayangudi Police Station. 2.A perusal of the charge sheet reveals that the petitioners herein have been charge sheeted with offences under Sections 329(4), 296(b), 118(1), 125 & 351(3) of the Bharatiya Nyaya Sanhita (BNS), 2023. The petitioners herein who are arrayed as accused Nos.1 and 2 are said to have entered into the houses of the witness LW1 to LW3 and said to have attacked them with Aruvalmanai. The 2nd accused is said to have thrown a stone on LW1 and caused inflammation at the left leg.

3.According to the learned counsel for the petitioner, the Accident Register and the wound certificate do not reveal any injury to the victims and therefore, no case has been made out as against the petitioners. 4.However, a perusal of the Accident Register and the Wound Certificate reveal the injuries on the witnesses. It is for the trial Court to 2/4

appreciate the evidence and decide the issue. When specific overtacts have been alleged as against the petitioners, no grounds have been made out to quash the charge sheet. All the arguments raised by the petitioners are left open.

5.The presence of the petitioners is dispensed with unless it is specifically directed by the trial Court.

6.With the above said observations, this criminal original petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
