ORDER: The Court made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 296(b), 351(3) of BNS Act and Section 4 of TNPHW Act 2002 in Crime No.718 of 2025, on the file of the respondent police, seek anticipatory bail.

2.The case of the prosecution is that on 18.09.2025 at about 8.30 am. the defacto complainant's husband who is the petitioner herein caught hold of her hair and slapped on her on right cheek and the petitioner dragged the defacto complainant outside the house and abused her in filthy language and demanded money for consuming alcohol. Thereafter, the petitioner attacked the defacto complainant by using iron rod causing multiple injuries all over body and the petitioner pulled down and tore her saree. Hence the defacto complainant made a complaint to the respondent police. Based on her complaint a case was registered and he was arrested and remanded to jail. Now the petitioner was released from jail about 20 days ago and has been staying with the defacto complainant for the past four days. On 06.12.2025 at about 11.00 p.m., the petitioner returned home in an intoxicated condition and again created problems and disturbance to the defacto complainant and her children. Hence, a case has been registered as against the petitioners. 2/6

3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and the petitioner has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4.The learned Government Advocate (Crl. side) appearing for the respondent submitted that the offences committed by the petitioner are serious in nature. Further, the petitioner has one previous case against him. 5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. 6.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, on condition that the petitioner shall execute a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the Learned Judicial Magistrate Court No.III, Tirunelveli District, within a period of fifteen days from the date on which the order copy made ready and on further conditions that:

[a]the petitioner and the sureties shall affix their photographs and left 3/6

thumb impression in the surety bond and the Magistrate may obtain a copy of their Aadhaar card or bank pass book to ensure their identity. [b]the petitioner shall stay at Madurai report before the Inspector of Police, Tallakulam Police Station, Madurai, until further orders. [c]the petitioner shall not tamper with the evidence or witness either during investigation or trial.

[d]the petitioner shall not abscond either during investigation or trial. [e]On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner is released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f]If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
