ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences under Sections 296(b), 131 and 351(3) of BNS and Section 4 of the Tamilnadu Prohibition of Harassment of Women Act, in Crime No.593 of 2025 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that on 28.08.2025 at about 08.00., the petitioner abused the defacto complainant and threatened her for damaging the windshield of his car. Hence, the complaint.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offences as alleged by the prosecution. He further submitted that the petitioner is ready and willing to abide by any conditions which may be imposed by this Court. Hence, he seeks anticipatory bail to the petitioner. 2/5
4. The learned Government Advocate (Crl.Side) submitted that there is no previous case pending against the petitioner and no one injured in this case.
5.Considering the facts and circumstances of the case and that the offence committed by the petitioner is serious in nature and that the petitioner has not allowed the other religious people residing in his area and deliberately pelted stones at the church, which is against the constitution, this Court is not inclined to grant anticipatory bail to the petitioner. The respondent is directed to arrest the petitioner and proceed further 6.Accordingly, this Criminal Original Petition stands dismissed. (S S Y J) 05.01.2026 vsg 3/5
