O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to conduct survey and measurement in respect of the land in Survey No.435/12, situated at Muthuvanthidal Village, Melachorikkulam Group, Thiruppuvanam Taluk, Sivagangai District and issue the survey report to the petitioner, based on the appeal dated 06.11.2024 after considering the payment made by the petitioner on 15.12.2023 and the representation dated 16.12.2025 submitted to the third respondent.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the petitioner had earlier filed a petition for survey of the petitioner's land; that though the second respondent surveyed the property, he laid Page No. 2 of 5

temporary survey sticks instead of survey stones; that thereafter, the adjacent landowners objected to the laying of survey stones; that therefore, the petitioner filed an appeal under Section 11 of the Survey and Boundaries Act on 06.11.2024 seeking to conduct a proper survey; that a reminder was sent to the first respondent on 16.12.2025; that further, the petitioner sent a representation dated 16.12.2025 to the third respondent seeking police protection; and that since none of the representations evoked any response, the petitioner was constrained to file the present Writ Petition.

The learned Additional Government Pleader appearing for the first and second respondents would submit that after consideration of the claims of the parties, proper steps would be taken to demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

5. Recording the aforesaid submissions, this Court directs the first and second respondents to consider the petitioner's appeal dated 06.11.2024 and the reminder dated 16.12.2025, demarcate the petitioner's land after consideration of the claims of all parties and pass orders in Page No. 3 of 5

accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923, within a period of twelve weeks from the date of receipt of a copy of this order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the Civil Court. It is needless to state that if required, police assistance shall be provided subject to payment of the requisite charges by the petitioner.

6. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
