PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the fifth respondent to grant the petitioner full access to operate the Indian Bank locker number 91.

ORDER
The present writ petition has been filed seeking a Mandamus directing the fifth respondent bank to permit the petitioner to operate the Indian Bank Locker No.19, which is in the fourth respondent Office. 2.According to the learned counsel for the petitioner, the locker was allotted jointly in the name of the petitioner and his wife. He further submits that due to her health conditions, the petitioner's wife is in the custody of the Canada Government and therefore, he is not in a position to reach out her to get her consent. Therefore, the petitioner seeks direction from this Court against the Bank to operate the locker. 3.The learned counsel appearing for the respondents 2 to 5 brought to the notice of this Court that the petitioner's wife has given a request in 2/5
writing that no one should be permitted to operate the locker without her consent. In fact, on 13.02.2023, the petitioner himself addressed a communication to the fifth respondent Bank that the locker can be operated only when the petitioner as well as his wife appeared before the Bank.
4.In view of the aforesaid circumstances, it is clear that unless the petitioner and his wife approach the concerned bank with appropriate records, the petitioner cannot be permitted to operate the Bank locker. In case the petitioner gets any orders from the Courts of Canada with regard to operate the locker, in such circumstances the Bank may consider such request.
5.With the aforesaid observations, the writ petition stands disposed of. No costs.
