O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to conclude the enquiry proceedings pending in Na.Ka.No.5848/2024/A1, initiated on the application made by the petitioner for cancellation of patta in respect of Survey No.529/3, situated at Keelavalvu Village, Melur Taluk, Madurai District.

With the consent of the learned counsel for the petitioner and the learned Government Advocate for the first and second respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with notice to the third respondent, as no adverse orders are proposed to be passed against her.

3. The learned counsel appearing for the petitioner would submit that the subject land in Survey No.529/3 is a pathway providing access to the petitioner's house site lands for ingress and egress; that the Highways Department acquired the said land for laying roads and paid compensation to the petitioner; that however, the third respondent has claimed that the Page No. 2 of 5

said land in Survey No.529/3 is her property and has obtained patta by unlawfully influencing the revenue authorities; that therefore, the petitioner made an application dated 06.08.2024 to the first respondent for cancellation of patta; that the first respondent issued enquiry proceedings in Na.Ka.No.5848/2024/A1 on 25.10.2024, directing the petitioner to appear on 05.11.2024; that though the petitioner appeared in person on that day and submitted all the documents, thereafter no steps have been taken by the first respondent to conclude the proceedings; and that therefore, the petitioner was constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the first and second respondents would submit that the petitioner's application would be disposed of within a period of eight weeks.

5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the first respondent to conclude the enquiry in Na.Ka.No. 5848/2024/A1 and pass appropriate orders on its merits and in accordance with law and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. disposed of after conducting an enquiry. The first respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, the third respondent and any other interested parties who may be affected by the decision.
