ORDER

The present writ petition has been filed seeking to quash the order passed by the first respondent herein wherein the petitioner has been called upon to offer his explanation for the adverse remarks received by the concerned police station.

2. By consent this Writ Petition is taken up for final disposal.

According to the learned counsel appearing for the second respondent, the petitioner has been implicated in a case in Crime No.305 of 2017 on the file of the second respondent police station, which has culminated in filing of a charge sheet in Judicial Magistrate, Virudhachalam on 15.07.2017. So far charge sheet has not been taken on file and it has been returned due to certain defects. Therefore, it is clear 2/4

that for the past 8 years, charge sheet has not been taken on file and the police authorities have not taken steps to represent the charge sheet.

4. This Court in a judgment reported in (2014) 8 MLJ 61 [Jaihar Williams Vs. State of Tamilnadu, represented by its Secretary to Government, Home Department, Chennai], has categorically held that pendency of a FIR is not a legal impediment for issuance of a passport.

5. In view of the above said facts, the first respondent is directed to consider the request of the petitioner for issuance of a passport and pass orders within a period of four weeks from the date of receipt of a copy of this order.

6. With the above said observations, this writ petition stands disposed of. No costs. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
