O R D E R
This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to conclude the appeal dated 01.09.2025 filed by the petitioner in respect of Patta No.2029, relating to Survey Nos.2313, 2330, 2343 and 2344, situated at Aandankovil East Village, Manmangalam Taluk, Karur District, within a time frame to be fixed by this Court.
2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The case of the petitioner is that the subject property belongs to the petitioner's family members and was endowed to Sri Kamatchi Amman Temple. Till the year 2017, all the revenue records stood in the names of the trustees of the said Temple. Some of the petitioner's family members sold the endowed property to third parties without the knowledge of the others. In respect of the same, the petitioner made a representation to the third respondent, who forwarded the same to the Village Administrative Officer for enquiry on 31.12.2018. However, no steps have been taken thereafter. Meanwhile, the patta for the said survey Page No. 2 of 5
numbers has been wrongly issued jointly in the names of Periyasami Pillai and others. Therefore, the petitioner preferred an appeal dated 12.06.2025 before the first respondent, who in turn directed the third respondent to enquire into the matter. However, the third respondent has not taken any steps in this regard. Therefore, the petitioner once again filed an appeal dated 01.09.2025 before the second respondent, who on receipt of the same issued an enquiry notice dated 02.09.2025. Though the petitioner appeared for the enquiry on 12.09.2025 and submitted his explanations in writing along with all relevant documents, no order has been passed in the petitioner's appeal till date. Hence, the petitioner was constrained to file the present Writ Petition.
4. The learned Special Government Pleader appearing for the respondents would submit that the petitioner's appeal would be disposed of by the second respondent on merits and in accordance with law, within a period of eight weeks.
5. Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to dispose of the petitioner's appeal Page No. 3 of 5
dated 01.09.2025 on its merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The appeal shall be disposed of after conducting an enquiry. The second respondent is also directed to provide reasonable opportunity during such enquiry to the petitioner and any others who may be affected by such decision. There shall be no order as to costs.
