ORDER

This Criminal Original Petition is filed seeking to transfer the case in Crime No.174 of 2025 on the file of the 3rd respondent to the 2nd respondent or other investigation agency and further direct them to investigate and to file final report within the time stipulated by this Court.

2. When the matter is taken up for hearing, the learned Government Advocate(Crl.Side) submitted that the matter is all about a case and case in counter between the defacto complainant and one Murugan, Ramesh Kannan, Maheshwari, Malaisamy and Suseela. All the persons are accused in Crime No.174 of 2025 dated 21.06.2025 and are the relatives of the daughter of the petitioner herein. However, after investigation, the investigation officer had concluded the same as 2/5

'mistake of fact' by recording that the petitioner had given a complaint with exaggerated version and the matter is between family members.

3. For which, the learned counsel for the petitioner categorically contended that the petitioner is a senior citizen who suffered a head injury.

4. The learned Government Advocate (Crl.Side) had very promptly placed a copy of Accident Register before this Court. On perusal of the same, it could be understood that the petitioner had suffered no external injuries.

5. Hence, recording the same, this Criminal Original Petition stands dismissed giving liberty to the petitioner to file a protest petition before the jurisdictional Magistrate.
