ORDER

This Writ Petition has been filed seeking issuance of a Writ of Mandamus, directing the second respondent to correct the extent of the property in Survey No.1448/1C3, Durgaiamman Kovil, Mela Gudalur Village, Uthamapalayam, Theni District, to 06.88 acres instead of 04.50 acres, and to remove the name of Palaniammal from Patta No.6747, issuing the patta in the petitioner's name as per the sale deed in Document No.1608/1994 dated 30.05.1994, based on the petitioner's representation dated 24.11.2025.

2. By consent, the Writ Petition is taken up for final disposal at the admission stage itself.

3. The learned counsel appearing for the petitioner would submit that the petitioner is the lawful owner of the property in Survey No.1448/1C3, Durgaiamman Kovil, Mela Gudalur Village, Uthamapalayam, Theni District, as evidenced by the sale deed in Document No.1608/1994 dated 30.05.1994. Despite the lawful ownership, the patta (Patta No.6747) incorrectly records the name of Palaniammal and shows an inaccurate extent of 04.50 acres instead of the actual extent of 06.88 acres. Hence, the petitioner submitted a representation dated 24.11.2025 requesting correction of the patta to reflect the correct extent and to remove the name of Palaniammal, but no action has been taken by the second respondent. Hence, the present Writ Petition.

4. The learned Government Advocate appearing for the respondents would submit that, in the present case, the Revenue Divisional Officer, Uthamapalayam, Theni District, is the competent authority to consider the grievance raised by the petitioner.

5. In view of the above, this Court suo motu impleads the Revenue Divisional Officer, Uthamapalayam, Theni District, as the third respondent in the present writ petition.

6. Considering the above submissions, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the third respondent / Revenue Divisional Officer, Uthamapalayam, Theni District, to consider the petitioner's representation dated 24.11.2025 and dispose of it on merits and in accordance with law, after affording a reasonable opportunity of hearing to the petitioner, and any other persons who may be affected by such decision, within a period of twelve weeks from the date of receipt of a copy of this order. There shall be no order as to costs. NCC : Yes / No (K.SURENDER, J.) Index : Yes / No 21.01.2026 smn2 To:- 1.The District Collector, Theni, Theni District.
