PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 to 6 to consider the representation of the petitioner dated 01.12.2025 and to remove the encroachments namely, house building, EB building, toilet in S.F.No.623/5 by the seventh respondent and wooden fence on four sides in the middle portion of S.F.No.624 put up by the eighth respondent extent of nearly 10 cents located at Udumanpatti Village, Karaikudi Taluk, Sivagangai District by considering the representation of the petitioner dated 01.12.2025 within the time stipulated by this Court. ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.) This writ petition is filed seeking a direction to the respondents 1 to 6 to remove the encroachments in the subject property by considering the representation of the petitioner dated 01.12.2025. 2/6

2.The contention of the petitioner is that the private respondents have encroached upon the land classified as Government land. The representations made by the petitioner in this regard has not been acted upon. Hence, the petitioner has filed the present writ petition.

3.The learned Special Government Pleader appearing on behalf of the official respondents, based on the written instructions, submitted by the Tahsildar, submits that by considering the representation of the petitioner, survey has been conducted and encroachments were found in the Government land. Hence, proceedings has been initiated under the provisions of the Land Encroachment Act. Insofar as the eighth respondent, namely Stephen Raj, is concerned, it is submitted that he has put up a dwelling house and is residing therein, and steps are being taken to grant patta to him.

4.Heard the learned counsel appearing on either side and perused the materials placed on record.

5.Admittedly, there are some encroachments in the subject property. It is to be noted that necessary proceedings have already been initiated to remove the said encroachment under the provisions of the Land Encroachment Act. Hence, the authorities are directed to complete the said proceedings and remove the encroachment within a period of six months from the date of receipt of a copy of this order. 6.Insofar as the eighth respondent is concerned, the authorities are directed to consider and issue patta in his favour, subject to fulfillment of all statutory requirements.

7.With the above directions, this writ petition is disposed of. There shall be no order as to costs.
