ORDER : The Court made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police 1/4

for the offences punishable under Sections 318(4), 336(2), 336(3) of BNS in Crime No.58 of 2025 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the 1st accused worked as an Accountant in the De-facto complainant's hospital. Upon the verification of the CCTV footage for the period from 17.09.2025 to 19.09.2025, it was observed that the accused person has taken the bundle of money from her work place. Thereafter, while perusing the records maintained by her, it was also found that she had misappropriated sum of Rs.40,00,0000/- from the hospital account by creating false documents. Hence, a case has been registered. 3.The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence. He seeks this Court to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Criminal Side) strongly opposed to grant anticipatory bail to the petitioner. 5.It is seen that the petitioner/A3 is an auto driver. The allegation against 2/4

the 1st accused is that she has regularly taken cash from the hospital and has given the cash to the to the 2nd accused. The 3rd accused /petitioner has handed over the property document which is in the name of A1.

6. Taking into consideration the facts and circumstances of the case, the nature and gravity of the offence and the specific overt act against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner at this stage.

7. Accordingly, this Criminal Original Petition is dismissed. 19.02.2026 TMG TO 1.The Inspector of Police, CCB Police Station, Madurai city, Madurai District.
