This writ petition has been filed seeking issuance of a writ of mandamus, directing the respondents 1 to 2 to direct the third respondent to release all the original certificates of the petitioner without any delay and condition and to initiate appropriate proceedings against the third respondent for illegal retention of certificates, demand of money for returning the petitioner's documents, unfair labour practice and violation of labour law guidelines by considering the petitioner's representation dated 21.11.2025.
2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself. Having regard to the nature of the order proposed to be passed, notice to the third respondent is dispensed with. 2/6
3. Learned counsel for the petitioner submitted that the petitioner was employed under the third respondent and thereafter resigned from service. Despite accepting the resignation, the third respondent has failed to hand over the original certificates that were submitted by the petitioner at the time of his appointment. Learned counsel for the petitioner further alleged that the third respondent has demanded two months' salary for returning the petitioner's original certificates. In this regard, the petitioner has submitted a representation dated 21.11.2025 to the first respondent, requesting the return of his original certificates. Aggrieved by the same, the present writ petition has been filed.
4. Learned Government Advocate appearing on behalf of respondents 1 and 2 submitted that the first respondent would consider and dispose of the petitioner's representation within the stipulated time frame.
5. Recording the aforesaid submission, and since the representation has been made before the first respondent, this writ petition stands disposed of with a direction to the first respondent to dispose of the petitioner's representation dated 21.11.2025 within a period of eight 3/6
weeks from the date of receipt of a copy of this order, after providing a fair opportunity of hearing to the petitioner as well as the third respondent. No costs.
