PRAYER : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari, calling for the entire records pertaining to the impugned Sale Notice in E.P.No. 01/2025-2026 (1) and E.P No.01/2025-2026(4) both dated 04.12.2025 issued by the 1st respondent and quash the same as illegal. ORDER

The present writ petition has been filed challenging the sale auction notice issued by the first respondent under the Tamil Nadu Cooperative Societies Act, 1983, pursuant to the surcharge award passed under Section 87 of the said Act.

2.According to the learned counsel for the petitioner, he had already filed an appeal before the Co-operative Tribunal challenging the surcharge award and is yet to be numbered. He seeks interim protection. 3.Considering the fact that the sale auction notice has been issued to recover a sum of Rs.9,40,944/-, the sale proceedings shall be kept in 2/4

abeyance for a period of three months on condition that the petitioner shall deposit Rs.5,00,000/- to the credit of the second respondent on or before 31.01.2026. In case of any default, the first respondent is entitled to proceed in accordance with law. After the period of three months, in case the petitioner is not able to get interim order from the Tribunal, even then the first respondent shall be entitled to proceed in accordance with law.

4.The writ petition stands disposed of with the above observations. No costs. Consequently, the connected miscellaneous petitions are closed.
