O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus, directing respondents 1 and 2 to carry out an appropriate survey and demarcate the boundaries of the petitioner's lands comprised in Survey Nos.143/4B1, 143/4B2, 143/4B3 and 143/3C, situated at Sangankulam Village, Vallarendhal Group, Tiruppuvanam Taluk, Sivagangai District, based on the petitioner's survey fee payments made under Challan Nos.20250403010966 and 20250403010791, dated 03.04.2025.

2.Heard the learned counsel for the parties. By consent of both parties, the Writ Petition is taken up for final disposal at the admission stage itself.

3.The learned counsel appearing for the petitioner submits that the necessary fees were paid on 03.04.2025 for the survey and demarcation of the boundaries of the property in question. Since no action has been taken by respondents 1 and 2, the present writ petition has been filed. 2/5

The learned Additional Government Pleader appearing for respondents 1 and 2 submits that, after considering the claims of all interested parties, appropriate steps would be taken to survey and demarcate the land in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act, 1923.

In view of the above, this Court directs the first respondent to consider and dispose of the petitioner's application dated 03.04.2025 for survey and demarcation, on merits and in accordance with law. Notice shall be issued to the petitioner and the owners of relevant adjacent lands and appropriate orders shall be passed in accordance with Sections 9 and 10 of the Tamil Nadu Land Survey and Boundaries Act 1923, within a period of eight weeks from the date of receipt of a copy of this order. In the event of any rival claims, the same can be agitated before the competent civil court. No costs.
